Terms & Conditions
+ Liability Waiver
The rules, protections, and expectations that govern every Experience Guide reservation, in plain, searchable language.
Effective November 2026
This Agreement establishes a contractual relationship between Experience Guide LLC ("EXG") and you, the Customer.
By accepting these Terms & Conditions, you agree to:
- Assume full responsibility and liability for yourself, your guests, and your invitees.
- Release and hold harmless EXG, its owners, managers, employees, affiliates, contractors, and property owners (collectively, "the Company") from claims, damages, injuries, or losses arising from your stay, to the fullest extent permitted by law.
- Indemnify EXG against liabilities resulting from your actions or omissions.
Reservations are not confirmed until you have accepted these Terms & Conditions.
- Minimum Stay: Unless pre-arranged otherwise, most weekends in peak season require a 3-night minimum and a 12-guest minimum.
- Shorter Stays: Reservations of fewer than 3 nights are only accepted within 60 days of the scheduled arrival date, subject to availability.
- Smaller Groups: Groups of fewer than 12 guests are permitted; EXG reserves the right to bill at the 12-guest rate.
The individual accepting responsibility for a reservation ("Primary Guest") must provide their true and accurate legal name, and all reservation and booking documents must reflect the actual Primary Guest. Fictitious names, joke names, intentionally false names, misleading aliases, or intentionally inaccurate identifying information are prohibited.
The payment method used should belong to the Primary Guest unless EXG approves a legitimate third-party cardholder in advance. Legitimate third-party payments are permitted when approved by EXG.
EXG may require identity and payment authorization from both the Primary Guest and, where applicable, the third-party cardholder. This may include a government-issued photo ID and confirmation of the cardholder's name and the last four digits of the payment card. EXG will not require guests to email or otherwise expose a complete card number or CVV.
EXG may request or require identity/payment verification at any time before providing property access. A material discrepancy between the reservation identity, executed booking documents, ID, or cardholder information may place the reservation on hold pending verification.
Failure or refusal to satisfactorily complete verification may result in withholding of property access or cancellation of the reservation pursuant to this Agreement. Use of an unauthorized payment method, or intentional material misrepresentation of identity, constitutes a material breach of this Agreement. To the extent permitted by law, the Customer is responsible for losses, chargebacks, bank fees, reasonable administrative expenses, or other damages actually resulting from materially false or unauthorized information provided in connection with a reservation.
- Check-in is 4:00 PM, unless pre-arranged otherwise.
- Check-out is 12:00 PM, unless pre-arranged otherwise.
- Early or late check-in/check-out is subject to availability and can only be authorized within 48 hours of the scheduled arrival date.
- Failure to vacate at the designated check-out time may result in an additional-night charge, without further right of occupancy.
- Property address and access codes are provided 48 hours prior to arrival.
- Guests are required to pre-arrange a scheduled arrival time with EXG for a personal welcome and property tour.
- Guests with special needs should contact EXG prior to booking to confirm the property can accommodate them.
- Street parking may be available but is not guaranteed.
- Guests are responsible for reading all posted signage. EXG is not liable for tickets, towing, or related expenses.
- In the event of overbooking, scheduling conflicts, or unexpected property issues, EXG reserves the right to relocate the Customer to accommodations of equal or greater quality within its own or affiliate properties, without liability.
- EXG cannot guarantee flexibility for reservation changes or special requests outside of these Terms.
- Occupancy Limits: No more than the number of guests listed on the reservation may occupy or enter the property.
- Unauthorized Guests: Any unregistered guest present at the property will result in a minimum $250 administrative charge per person.
- Events & Gatherings: Private events and group gatherings outside standard vacation-rental lodging must be approved by EXG prior to booking. Use of the property for an unapproved event, party, or gathering will result in a minimum $1,000 charge to cover documented damages and remediation costs, cancellation of the reservation, and eviction without refund.
- Noise: Denver noise laws apply from 10:00 PM to 8:00 AM nightly. A violation results in a minimum $1,000 administrative charge to cover the cost of managing the disturbance and may result in eviction without refund. Please be respectful of neighbors.
- Customers are fully responsible for all persons entering the property.
- Tobacco: Smoking or tobacco use, including spliffs or tobacco-blended products, is prohibited inside the property or within 25 feet of entrances. Minimum cleaning charge: $500.
- Cannabis: Permitted in accordance with state and local law. Customers assume all risks and liabilities related to cannabis consumption. Additional charges may apply for cannabis use inside a rental property; please inquire prior to booking.
- Pets: Not permitted. Evidence of pets will result in a minimum $500 cleaning charge.
- Adult Entertainment: Strippers, exotic dancers, escorts, or prostitutes are prohibited on the property unless pre-authorized by EXG. Violations will result in a minimum $1,000 charge per incident.
- Customers are responsible for keeping the property and furnishings in good condition.
- Moving, damaging, or misusing furniture or equipment will result in a charge equal to the actual documented cost of repair or replacement, plus reasonable administrative costs incurred by EXG.
- Cleaning Charge: Each reservation includes a standard cleaning charge of $250–$350, which covers routine cleaning only. Excessive cleaning needs (for example, stains, wax, glitter, large volumes of trash, damaged linens, or marijuana concentrate residue) will result in additional documented charges.
- Deliveries must be coordinated with EXG prior to shipping.
- EXG assumes no responsibility for lost or undelivered packages, including but not limited to Amazon deliveries and pre-stocking requests such as groceries or beverages.
Properties may use disclosed exterior security cameras, doorbell cameras, access-control systems, and reasonable noise-monitoring technology for guest and property safety. EXG does not place surveillance cameras in private interior sleeping or bathroom areas.
Guests may not intentionally cover, disable, disconnect, damage, or otherwise tamper with authorized safety or security equipment. A violation will result in a charge covering the documented cost to inspect, repair, or replace the affected equipment, per occurrence.
Payment Terms
- Reservations booked sixty (60) calendar days or fewer before arrival require payment in full at booking.
- Reservations booked more than sixty (60) calendar days before arrival require a 25% deposit. The remaining balance must be paid in full on or before the date that is sixty (60) calendar days before the scheduled arrival date. The Customer authorizes EXG to charge the payment method on file for the remaining balance on or before that date. A declined, failed, or disputed charge does not extend the payment deadline.
- Failure to pay the full balance by the applicable deadline is a material breach of this Agreement. If the balance is not paid by the deadline, EXG may, at its discretion, place the reservation on hold, withhold property access, cancel the reservation, and release the reserved dates for other bookings. EXG may give written notice or allow additional time to pay, but is not required to do so. Any additional time is effective only if confirmed by EXG in writing and does not change the payment deadline for other reservations.
- Additional guests beyond included base occupancy are generally billed at $50 per person, per night.
- All charges appear on your statement as EXPERIENCE GUIDE LLC.
Where a Reservation Itinerary, promotion, pay-in-full offer, holiday offer, package, or other reservation-specific written offer states different payment or cancellation terms, that specific written offer controls for that reservation to the extent it conflicts with these general policies.
Cancellation Policy
Cancellation by the Customer. If the Customer cancels a reservation, the following terms apply. โDays before arrivalโ means calendar days before the scheduled check-in date.
- If the Customer cancels within forty-eight (48) hours after booking and arrival is at least sixty (60) calendar days away, EXG will refund all amounts paid.
- If the Customer cancels within seven (7) days after booking and arrival is fewer than sixty (60) calendar days away, EXG will issue a credit for amounts paid, valid for twelve (12) months from the original arrival date.
- If the Customer cancels more than sixty (60) calendar days before arrival, EXG will issue a credit equal to seventy-five percent (75%) of amounts paid, valid for twelve (12) months from the original arrival date. The remaining twenty-five percent (25%) is nonrefundable.
- If the Customer cancels sixty (60) calendar days or fewer before arrival, payments are nonrefundable and no credit or rescheduling will be provided.
Credits are nonrefundable, may be used only toward a future reservation booked directly with EXG, and must be used within the stated validity period. Any different cancellation terms in a reservation-specific written offer control for that reservation.
Cancellation for Nonpayment or Other Customer Breach. If EXG cancels a reservation because the Customer failed to pay the balance by the deadline in the Payment Terms, or because of another material breach by the Customer, the cancellation will be treated as a cancellation by the Customer under this policy. EXG may release the dates for other bookings. Cancellation does not waive amounts that were due under the reservation before cancellation. Any amounts recovered through rebooking the same dates will be credited against any damages EXG seeks for the same loss, to the extent required by law.
Cancellation by EXG Without Customer Breach. If EXG cancels a reservation for a reason not caused by the Customerโs breach, EXG will refund all amounts the Customer paid to EXG for the canceled reservation. The Customer may instead choose, in writing, an available alternative property or dates offered by EXG.
Chargebacks & Disputes
- Guests with billing concerns are encouraged to contact EXG directly before initiating a dispute.
- If a chargeback or payment reversal causes an upcoming reservation's required balance to become unpaid, EXG may place the reservation on hold or cancel it under the Payment Terms, and the associated dates may be released and rebooked.
- Property access may be withheld while a balance related to a disputed charge remains unpaid.
- If a chargeback is later resolved in EXG's favor, dates that have already been released or rebooked will not automatically be reinstated.
- Filing a payment dispute does not, by itself, erase otherwise valid contractual obligations under this Agreement.
- To the extent permitted by law and this Agreement, EXG may recover reasonable bank fees, administrative expenses, collection costs, and legal costs incurred in responding to a dispute.
- Arbitration: All disputes are resolved exclusively by binding arbitration under the American Arbitration Association in Colorado.
- Governing Law & Jurisdiction: This Agreement is governed by Colorado law. If arbitration is waived, disputes must be filed in the District Court for the City & County of Denver.
- Attorney's Fees: The prevailing party in litigation or arbitration is entitled to recover reasonable costs and legal fees.
- Amendments: Must be in writing and signed by both parties.
- Entire Agreement: This Agreement supersedes all prior agreements between the parties on this subject.
- Severability: If any provision is held invalid, the remainder of the Agreement remains in effect.
- Waiver: Failure to enforce any right under this Agreement does not waive future enforcement of that right.
The Customer acknowledges and agrees that, to the fullest extent permitted by applicable law:
- EXG, its owners, employees, property managers, affiliates, and contractors are not liable for accidents, injuries, illnesses, theft, loss, or damages occurring during the stay.
- All risks of lodging, transportation, and activities undertaken during the stay are assumed by the Customer and their guests.
- Disturbances from construction, roadwork, or external noise beyond EXG's control are non-actionable.
- By booking, the Customer releases, discharges, and holds harmless EXG and its affiliates from liability, including for personal injury, death, property damage, or loss, however caused, except to the extent such liability cannot be waived under applicable law.
